    There is a very GREY area regarding file sharing ann there is no perfect solution. It's the same thing in the music industry. Billions of song files are\have been shared and the artist is not compensated. And I'm certainly not trying to create distain among our members, just passing some info along. So everyone bear with me for a minute.

    My understanding of everything that I've read on digital piracy on this and other forums boils down to this:

    1. You are allowed to post any image created with SBM to this SMB Gallery.

    2. You are allowed to post a template if you personally created and\or have license to (i.e. the original content that comes with SBM)

    3. You should NOT post a template using other people's embellishments unless you have their permission

    4. You should not post embellishments that you have paid for. Most TOU's say they are for your PERSONAL use only.

    5. You should NOT distibute any fonts, regardless if you've paid for them.

    6. You should NOT claim the work as your own unless you personally created the content or have license to do so.

    7. You are NOT allowed to resell templates.


    EXAMPLE:
    If I created a template using one of Moonbeam's lacey embellishments (sorry, Moonbeam) and claim the work as my own without giving her credit and her permission, that's a NO!

    EXAMPLE:
    If I purchased a kit and posted a few embellishments to this forum, that's a NO!

    EXAMPLE:
    I created a template using content that was supplied from the SBM program or another approved source or content that' I've personally created in Photoshop, that's OK!

    I hope this helps a little and gets eveyone thinking about this topic!

    I have not been sharing as I too have been Concerned

    I think that if you share your templates and your Embellishments on this site
    You can use them at any time as you are giving them to share

    I was sharing Embellishments that I only had in my embellishment box
    I scanned them and i extracted them and I shared them.

    A person used my embellishment and it made me happy to see a person using them

    I think if you do not want anyone using them as don't share.

    I love this site Its my second home but it is getting harder

    Have one Question I have been downloading great embellishments of www.freedigitalscrapbooking.com can i use the embellishment maker a place them into scrapbook max and i think i can use them in the gallury and have there name on it. Is that right???

      If you're not sure what to do, check the Terms of Use of the site\user that provides the content. Free Digital Scrapbooking has this link on their site that states their policy on sharing. It's their content, so they make the rules of how it can used.



      - You CAN modify their content for your own personal use.
      - You CAN submit layouts to other sites or mags (such as SBM Gallery)
      - You CANNOT redistribute
      - You CANNOT resell
      - You CANNOT use for commerical purposes without permission
      - You must include a credit or link to their site

        If I may add a few comments....

        Clipart or images that are scanned from magazines, books and other sources, or download from the net, and then one removes the background or recolors, is still copyrighted and should not be distributed. Is ok to post them on the gallery for others to admire how you use them, but it's not ok to give it to others.

        It's wonderful to have a sharing spirit and to be helpful, but it's also wonderful to respect other people's work. I had to quit another forum because the owner of the site was giving away hundreds of programs with the cracked codes. How her conscience allowed her to do that, I'll never know. But then one day she screamed bloody murder because someone copied a list of links from her site and posted it on theirs. That was a real no no to her. Go figure!

        The safest way to share is to direct people to the sites that offer freebies. That accomplishes the purpose of freebies. Bring people to their sites.

        Think of it this way. You go to Costco and there are these little tables set up where a nice lady is giving away bite size samples of one of the products. These allows you to "sample" the merchandise and encourage you to buy the product. But would you start opening all the cans and giving them away to every one you know? For free? How long would it be before Security would nicely show you the way to the doors, or worse?

        Designers are not being mean by making rules on sharing, they are just trying to protect their work and make a living, while at the same time giving you some goodies.

            It is important to note that you should only post templates that you have created yourself, with embellishments you have made yourself (or you have permission from the copyright holder to use them in your template). Uploading files that are not yours to share is a big no-no.
            . this is a learning curve for all of us.. I know I posted some No no's in the beginning before I even thought about copyrights Derr!!
            But this is from Admin here on Scrapbok Max.. so thats what we need to apply to our sharing here.
            To me that reads we really shouldn't share a template If we didn't create it ourselves... to just show others we need to put it in the gallery not share it.
            Apart from the legal ramifications we do not want to spoil the nice atmosphere we have here by offending others.

              ( Have just moved these posts from the other thread) Again Steve thanks for that.. Your explanation is very clear and plain ... and I should mention too that I have had it happen to me, that someone has taken a template I created and shared then a month later put it one here to share "her creation" .. I felt quite hurt .. but did and said nothing believing that it was just her choice of words... but your detailed list there really shows us we should not post a template to share if it's one we haven't created ourselves.
              So I guess the key factor in sharing is "Did I personally make all the elements in this? " OR do I have the license to SHARE this? other wise put it in the Gallery anyway.. we all love viewing the gallery
              ... and I guess this will come up again and again over time as new ones enter the forum and /or we forget ( senility)

                Yes and thats why we have to remember to make sure they are "free" to be used that way. It's different from a site where we download a freebie..because they are for our own personal use not to share in a forum situation. But seeing there is such a nice spirit here , and I hope it stays that way, if we make a thoughtless mistake and someone picks us up on it - be thankful and learn from it - do not take offense.I bet there is not 1 of us who hasn't inadvertantly posted something to share that shouldn't be shared, especially when we first started.

                I think the problem is not that people dont want others using stuff - its when they feel deprived of the rightful credit for their work.. which makes OnieRN's idea about putting our username in the titlw when we upload for sharing a good idea, as then the user can readily identify who they originally got it from.

                  I may be wrong but I honestly believe that IF I post a templete in the Sharing Corner then I am giving permission for others to use it. I personally would not post anything that I didn't want others to use. After all, why are we posting them? If it's just to show off our layouts then put it in the gallory. Again, if you use your name in the file name then you will be getting credit.

                    Scrapbooking Trends

                    A new trend that seems to be occuring in the digital scrapbooking arena (that's funny, it's sounds like gladiators going at it in the collseum... ) is to include a "Terms of Use" graphic with the kits...

                    One suggestion would be to add an additional page right in your SMB template or an additional image with the Embellishments the with these Terms of Use. The "designer" can state his\her intentions there.

                    Personally going to start doing this on any new templates and embellishments that I post so there is no confusion. I would suggest other designers do the same.

                    I'm more than happy to share my work (God knows, I've contributed plenty) and love the spirit of this group in this forum. And I will continue to do with as much moxie as I can muster.

                    Piracy (Scrapbook Pirates? ARGGGGGGH) is running rampant in all areas of media (music, film, books, etc) and it's VERY IMPORTANT that people be educated on what is proper and what is not. If we don't do something about it now, it's just going to worse and no one will want to contribute anything. That's defeats the purpose of why we share in the frst place.

                    Ok, I"m stepping down from my soapbox...

                      very Good Mayor Steve,
                      its true it is an educational thing.. seeing digital scrapbooking is relatively new and SBM forum is very new and the sharing corner...
                      I think the idea about putting a terms of use with the downloaded folder for that particular item is a great one... we can check before we use it.
                      Not all have this though at this stage so I have created my own folder labelled "Approved for distribution" if it 'aint in there I can't share it.
                      Steve, like you I love the forum here and dearly want it to stay like it is..a wonderful sharing spirit. I know you have given many of your own personal creations for us to use over time and I thank you for that.

                        You know what's funny... I've been going to several of the "Freebie" sites that people of this forum have been using and reading their License Agreement and Terms of Use.

                        They pretty much the same thing... All the items mentioned in the start of this thread.

                        I know I can't change the world... just trying to change my little piece of it.

                          Digital piracy is easy done inadvertantly.. sometimes we just don't think about it! thats why this thread is so necessary. I know If you went over my shared templates when I first started there would be heaps in there that were not supposed to be shared ... I was just so excited about being able to put all this wonderful stuff together and let others have it, and I NEVER gave copyrights a thought - not one!..
                          I am trying now to put my brain into gear before I share files ( don't say it Steve)
